1. Parties and scope

These Terms & Conditions (“Terms”) apply to purchases of the Services described below through rubelis.eu. They are accepted by ticking the relevant box on the registration form before payment; simply browsing the website does not create a contract.

Who your seller is. There are two sellers on rubelis.eu. The seller is determined by your answers on the registration form, which asks whether you are a citizen of the Republic of Türkiye and in which country you live. Your seller is shown on the form before payment and in the order confirmation email.

  • Citizens of the Republic of Türkiye who live in Türkiye buy from Taylan Kırali, sole proprietor, Rubelis’s exclusive distributor in Türkiye under agreement no. RB-OÜ-TR-2026-001 of 19.08.2026 (Atatürk Cd. EGS Business Park No:12/1, Yeşilköy, Bakırköy, Istanbul; Bakırköy Tax Office, tax no. 5560293797; KEP taylankirali@hs01.kep.tr). Payment is made in Turkish lira through Garanti BBVA. For these orders Turkish law applies, and the sale is governed by the Turkish pre-contract information form and distance sales contract rather than by these Terms.
  • Everyone else, including citizens of Türkiye who live abroad and foreign nationals who live in Türkiye, buys from Rubelis OÜ, a private limited company registered in Estonia (registry code 17579501, VAT no. EE103024666, registered address Tartu mnt 67/1-13b, 10115 Tallinn, Estonia) (“Rubelis”, “we”, “us”). Payment is made in euros through Stripe. These Terms form the contract between you and Rubelis OÜ.

Rubelis OÜ owns all Rubelis programmes, content and intellectual property, whichever seller you buy from.

Before ordering, please also read the Pre-contract Information and the Cancellation & Refund terms.

2. Description of the Services

Service Price (Rubelis OÜ)
Rubelis Presence Diver course 189 €
Rubelis Presence Diver course for Rubelis Beyond Diver holders 139,10 €
Theory only: Rubelis Beyond Diver 49,90 €
Presence Instructor training 199 €
  • Rubelis Presence Diver course: a PADI Distinctive Specialty course comprising the online theory component (the Rubelis Beyond Diver programme), two open water training dives at Guru Dive Doğa Sporları ve Eğitim Merkezi in Istanbul, Türkiye, all dive equipment used on the dives and, once all performance requirements are met, the PADI certification fee. The price applies to training at Guru Dive Istanbul.
  • Presence Diver course for Beyond Diver holders: the same course for holders of the Rubelis Beyond Diver certificate, with the theory price deducted. Your Beyond certificate number is required at registration.
  • Theory only (Rubelis Beyond Diver): the twelve-chapter online reading programme with lifetime access and the QR-verifiable Beyond certificate. It includes no in-water training and no PADI certification.
  • Presence Instructor training: the Beyond Diver theory programme, instructor training in online sessions, the first-year licence, materials and instructor portal access for PADI Instructors who want to teach the course. The PADI rating application fee is not included. The training is governed by the separate Presence Instructor Licence Agreement.

Travel and accommodation are not included. Paying the course fee does not guarantee certification; certification is earned by meeting all of the course’s performance requirements.

3. Eligibility and minors

Participants in the dive course must hold at least a PADI (Junior) Open Water Diver certification or an equivalent certification from another training organisation. The minimum age is 12; nobody under 12 may dive. The theory programme must be completed before the first dive.

Participants under 18. Registration, the contract and payment for anyone under 18 are made by a parent or legal guardian on the child’s behalf. When the date of birth entered shows that the participant is under 18, the registration form asks for the parent’s or guardian’s details and declaration, and the order confirmation is also emailed to the parent or guardian. Before any in-water session, a parental consent document and a medical statement co-signed by the parent or guardian are required. Participants under 18 dive with an instructor and follow PADI junior diver limits. How we handle children’s data is explained in the Children’s Privacy Notice.

4. In-water training, authorised dive centre and medical statement

Training provider. In Türkiye, all in-water training is provided by Guru Dive Doğa Sporları ve Eğitim Merkezi, a dive centre authorised by the Turkish Underwater Sports Federation (Türkiye Sualtı Sporları Federasyonu, TSSF), registry no. 755, and a PADI 5 Star Dive Center and PADI Eco Center, under service agreement no. RB-OÜ-GD-2026-001 of 20.10.2026 between Rubelis OÜ and Guru Dive. Guru Dive keeps the student file, makes the notifications to the TSSF (course forms and dive permit IDs) and collects the medical statement and other forms.

Authorised-centre rule. Under the TSSF regulations on scuba diving (Donanımlı Dalış Talimatı), dive training in Türkiye may only be given by TSSF-authorised dive centres or clubs and by instructors registered under their authorisation. The open water dives are conducted by PADI Instructors registered under Guru Dive’s authorisation. Theory-only customers and Presence Instructors may complete in-water skills only at an authorised dive centre with an instructor registered under that centre’s authorisation.

Dive permit ID. Citizens of Türkiye who do not hold a TSSF/CMAS diver card dive with a TSSF dive permit ID (dalış izin kimliği) (Talimat art. 22/5). The dive centre arranges it; any federation fee, if any, is paid at the dive centre.

Medical statement. We do not collect health information on rubelis.eu. The PADI Medical Statement and liability release are completed only before in-water sessions, at the dive centre, with the instructor who conducts the dives.

Insurance. Personal dive or accident insurance is not included in the price. We recommend that you take out dive insurance (for example with DAN).

5. Prices and payment

Prices are shown in euros and include applicable taxes. Payment is taken on Stripe’s secure payment page. Rubelis does not see or store your card details. Any currency conversion or foreign transaction fees charged by your bank are borne by you. (For buyers who are citizens of Türkiye and live in Türkiye, prices in Turkish lira including 20% VAT and payment through Garanti BBVA 3D Secure apply under the Turkish documents referred to in section 1.)

6. Order steps and correcting input errors

  1. You fill in the registration form.
  2. You review your entries. You can correct any field on the form before you press “Complete registration and pay”.
  3. You tick the required confirmation boxes: the Pre-contract Information; these Terms and the Cancellation & Refund terms; that you have read the Privacy Notice; your request for immediate access to the theory programme; for instructors, the licence conditions; and, for participants under 18, the parent’s or guardian’s declaration. Consent to marketing emails is optional, not pre-ticked and offered to adults only.
  4. You are redirected to the secure payment page (Stripe, or Garanti BBVA for buyers from the Turkish seller).
  5. The payment is approved.
  6. An order confirmation email is sent to you immediately. The contract is concluded when the payment is approved.

7. Storage of the contract and language

We store the contract text and send it to you on a durable medium in the order confirmation email. The email contains the seller, the order number, the service, the total price, payment and performance details, full information on the right of withdrawal including the model withdrawal form, a record of the confirmations you ticked with the date, time and text version, the complaint routes and links to the full texts. The full texts remain published on rubelis.eu; the version that applies to your contract is the one you accepted, as recorded in the order confirmation.

The contract language is English or Turkish, depending on the language of the form you used.

8. Right of withdrawal

If you are a consumer, you may withdraw from the contract within 14 days of its conclusion without giving any reason and without any penalty, by sending a clear statement to info@rubelis.com or by post to Rubelis OÜ, Tartu mnt 67/1-13b, 10115 Tallinn, Estonia. You may use the model withdrawal form, but you do not have to. Refunds are made within 14 days of receiving your notice, to the original payment method and free of charge.

  • Theory programme (digital content). Before payment, you expressly request immediate access to the theory programme and acknowledge that you thereby lose your right of withdrawal for the theory price. Once access is opened, the right of withdrawal no longer applies to the theory price (49,90 €) (Directive 2011/83/EU, art. 16(m)). This request and acknowledgement are confirmed in the order confirmation email.
  • Dive services and instructor training started during the withdrawal period. If, at your express request, a service starts during the withdrawal period and you then withdraw, you pay an amount proportionate to what has been provided up to the time you inform us of your withdrawal (Directive 2011/83/EU, art. 14(3)).

Further cancellation and refund rules, which are more generous than the legal minimum and do not limit it, are set out in the Cancellation & Refund terms.

9. Intellectual property and educational content

Protected materials include, where applicable: course texts, training modules, chapters, original explanations, original instructional narratives, assessments, examination questions, quizzes, original tables, original diagrams, original graphics and illustrations created by Rubelis, case studies, original stories, training transcripts, student and instructor materials, downloadable original materials, and original web content created by Rubelis.

Rubelis OÜ makes no claim over third-party software used in the platform, licensed stock photographs, third-party fonts or visuals, or third-party certification standards (such as PADI, SSI, CMAS, or CPD Certification Service). These materials are distinct from those owned by or used under licence by Rubelis OÜ.

Enrolling in a Rubelis programme, making a payment, or obtaining membership or access does not transfer ownership of any intellectual property right of Rubelis to you. You are granted only a limited, personal, non-exclusive, and non-transferable licence to access and use the relevant educational materials for personal learning purposes. This licence may be terminated in the event of a material breach of these Terms, to the extent permitted by applicable law.

Unless Rubelis OÜ has given prior written consent, or applicable mandatory law expressly permits it, the following are prohibited: copying substantial portions of course content; systematic extraction of content; republishing course texts; uploading course materials to other websites; distributing, selling, or commercially re-using materials; publishing unauthorised translations; converting materials into competing commercial training programmes; systematically recreating content through screenshots; distributing materials in formats such as PDF or e-book without authorisation; sharing account or course access with third parties; scraping; collecting content via bots or automated tools; systematic data extraction; and using content without authorisation to train artificial intelligence or machine-learning models.

10. Safety and liability

Open water dives are conducted by a PADI Instructor registered under an authorised dive centre’s authorisation, within PADI standards and safety procedures. You remain responsible for diving within your certification level and personal limits, for giving accurate information on the medical statement, and for following your instructor’s safety instructions.

Subject to the following paragraph, Rubelis OÜ’s liability for any claim arising from the Services is limited to the amount you paid for the relevant Service, and we are not liable for dives conducted at places or with persons that are not authorised.

Nothing in these Terms, and nothing in any liability release signed at the dive centre, excludes or limits liability for intent or gross negligence, liability for death or personal injury caused by fault, or any other liability that cannot be excluded or limited under applicable law (including the Estonian Law of Obligations Act and mandatory consumer protection law). Your statutory rights as a consumer are not affected.

11. Changes to these Terms

We may update these Terms. Changes apply only to orders placed after the new version is published. Existing contracts remain subject to the version you accepted, whose text version is recorded in your order confirmation.

12. Governing law and jurisdiction

Contracts with Rubelis OÜ are governed by Estonian law. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of the country in which you have your habitual residence (Regulation (EC) No 593/2008, Rome I, art. 6).

If you are a consumer, you may bring proceedings against us in the courts of Estonia or in the courts of the place where you are domiciled; we may bring proceedings against you only in the courts of the country in which you are domiciled (Regulation (EU) No 1215/2012, Brussels I bis, arts 17–19).

13. Complaints and dispute resolution

Please send any complaint to info@rubelis.com. We reply to complaints within 15 days.

If we cannot resolve a dispute, you may apply to the Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Estonian Consumer Protection and Technical Regulatory Authority (TTJA, ttja.ee). You may also use the consumer dispute bodies and courts of your country of residence.
