Cancellation, Withdrawal and Refund Terms

General information

The Rubelis Presence Diver course has two parts: a digital theory programme and open water dives on an agreed date. The following terms apply in line with applicable consumer protection and distance-selling law. They are more generous than the legal minimum in some respects and never limit your statutory rights.

There are two sellers on rubelis.eu: Taylan Kırali (Rubelis’s distributor in Türkiye) for buyers who are citizens of the Republic of Türkiye and live in Türkiye, and Rubelis OÜ for everyone else. Amounts are shown below in euros (Rubelis OÜ sales) and Turkish lira (Taylan Kırali sales); only the currency of your own order applies. The theory price deducted in the cases below is 49,90 € / 3.290 TL.

Right of withdrawal

The consumer has the right to withdraw from the contract within 14 (fourteen) days from the date the contract is concluded, without giving any reason and without incurring any penalty.

Theory programme (digital content). Access to the theory programme starts immediately after payment. Before paying, you expressly request this with a separate checkbox, which is required to complete the order, and acknowledge that you thereby lose your right of withdrawal for the theory price. Once access is opened, the right of withdrawal no longer applies to the theory price (49,90 € / 3.290 TL) (Directive 2011/83/EU, art. 16(m); for the Turkish seller, Distance Contracts Regulation art. 15(1)(ğ) and (h)). This request and acknowledgement are confirmed in the order confirmation email. If you bought the theory programme only, there is no right of withdrawal once access has been opened.

Services started during the withdrawal period. If, at your express request, dive services or instructor training start during the withdrawal period and you then withdraw, you pay an amount proportionate to what has been provided up to the time you inform the seller of your withdrawal (Directive 2011/83/EU, art. 14(3)).

Cancelling the course

Situation	Outcome

After theory access is opened, within 14 days of payment	The amount paid is refunded less the theory price (49,90 € / 3.290 TL).
After 14 days, more than 7 days before the dive date	The amount paid is refunded less the theory price (49,90 € / 3.290 TL).
After 14 days, fewer than 7 days before the dive date	No refund. You may change the date once, free of charge.
After the dives have taken place	No refund.
Dives cannot take place because of weather or sea conditions	The dives are moved to a new date agreed with you, free of charge.
The training cannot be delivered for reasons on Rubelis’s side	The full amount paid is refunded.

Where a dive was held during the withdrawal period at your express request, the proportionate amount described above is also deducted.

Presence Instructor training

If you withdraw within 14 days of payment and before attending a training session, the fee is refunded less the theory price (49,90 € / 3.290 TL). If a training session has started during the withdrawal period at your express request, a proportionate amount for what has been provided is also deducted. No refund is given after 14 days. Auction

The winning auction amount is non-refundable. If the training cannot be delivered for reasons on Rubelis’s side, the full amount is refunded. See the Auction Terms.

Refund process

Send your withdrawal notice or refund request to your seller:

• Rubelis OÜ: by email to info@rubelis.com or by post to Tartu mnt 67/1-13b, 10115 Tallinn, Estonia.
• Taylan Kırali (buyers who are citizens of Türkiye and live in Türkiye): by email to info@rubelis.com, by KEP to taylankirali@hs01.kep.tr or by post to Atatürk Cd. EGS Business Park No:12/1, Yeşilköy, Bakırköy, Istanbul.

Refunds are made within 14 days of receiving your notice, using the same payment method you used for the original transaction (the same card through Stripe or Garanti BBVA), and you will not incur any fees as a result. The time it takes for the amount to appear on your statement depends on your bank.
